Terms of Service

Welcome to SeINWorks. By accessing or using our platform (the “Service”) — including our website, mobile experiences, APIs, and any related communications — you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

1. Who Can Use SeINWorks

You must be at least 18 years old, legally able to enter into binding contracts, and not barred from using the Service under applicable law. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

2. Accounts & Verification

SeINWorks is a verified marketplace. Workers, employers, and recruiters must complete a two-step verification process — email confirmation followed by document review — before transacting on the platform (applying to shifts/jobs, posting shifts/jobs, or running AI talent matching). We reserve the right to approve, reject, suspend, or terminate any account at our sole discretion.

• You are responsible for all activity under your account.
• You must keep your password confidential and notify us immediately of any unauthorized use.
• You may not transfer or share your account.

3. The Marketplace

SeINWorks connects hospitality workers with employers and recruiters. We are nota party to the employment, contractor, or service relationship between users. All employment decisions, including hiring, compensation, scheduling, supervision, payment of wages, taxes, and benefits, are the sole responsibility of the contracting parties.

4. Fees & Payments

The Service may charge platform commissions, subscription fees, posting fees, or other charges as disclosed in-app. Payment processing is handled by third-party providers; you authorize them to charge your selected payment method for amounts you owe. Fees are non-refundable except where required by law.

5. User Content & Conduct

You retain ownership of content you submit (profile information, posts, photos, stories, messages). You grant SeINWorks a worldwide, royalty-free, non-exclusive license to host, display, and distribute that content on the Service. You agree not to:

• Post false, misleading, harassing, defamatory, or unlawful content.
• Solicit users to transact off-platform to circumvent fees.
• Impersonate any person or entity, or misrepresent affiliation.
• Scrape, reverse engineer, or interfere with the Service or its security.
• Use the Service for any illegal, discriminatory, or abusive purpose.

6. Verification Documents

When you submit verification documents (government ID, business licenses, certifications), you represent that they are genuine, lawfully obtained, and accurately depict you or your business. We may verify documents through third-party providers and retain them for compliance and fraud prevention purposes consistent with our Privacy Policy.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT ENDORSE OR GUARANTEE ANY USER, EMPLOYER, OR LISTING.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INKOSI LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) US$100.

9. Indemnification

You agree to defend, indemnify, and hold harmless Inkosi LLC from any claims, damages, liabilities, or expenses (including attorneys' fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of any third-party right.

10. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason, including breach of these Terms. You may close your account at any time by contacting support. Provisions that by their nature should survive termination will survive.

11. Governing Law & Disputes

These Terms are governed by the laws of the United States and the state in which Inkosi LLC is organized, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or the Service shall be resolved by binding arbitration on an individual (non-class) basis, except that either party may seek injunctive relief in court for intellectual property or confidentiality matters.

12. Changes

We may modify these Terms at any time by posting an updated version. Continued use of the Service after changes take effect constitutes acceptance. For material changes, we will provide notice via email or in-app banner.
